1.0 Introduction
As the Emvia Products and Services continue to undergo development (among other things, through the implementation of new technologies or the introduction of new services) this Privacy Policy may need to be adjusted accordingly. Emvia reserves the right to amend or supplement this Privacy Policy, as required, by publishing a new version here. It is your responsibility to familiarize yourself with the latest version, and by continuing to use the Service, you are deemed to consent to any such changes in the Privacy Policy.
This Privacy Policy is applicable to Sentio, LLC d/b/a Emvia (“we,” “our,” or “us”) as related to our services, which collectively include:
- the use of https://emvia.cx (“website”)
- social media messages and marketing campaigns, and
- the use of our products and services
This Privacy Policy sets out the essential details relating to your personal data relationships with Emvia as:
- A website visitor
- An end user of the platform (“end user”)
- A prospective client
- A job applicant, and
- Partners
Customers contract the use of our application and give access to their employees and other third parties, as solely decided by them, by creating users who access the application with their email address and credentials. The Customers’ administrators grant end users roles, which result in different permissions and access rights to the information held in the client account.
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on our website.
Emvia shall reserve the right to amend or supplement this Privacy Policy, as required, by publishing a new version to our website; it is your responsibility to familiarize yourself with the latest version, and by continuing to use the Services, you are deemed to consent to any such changes in the Privacy Policy. Therefore, you are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
1.1 Emvia/Customer as a Data Controller and Data Processor
“(Data) Controller” is an agency, entity, or legal person who determines the purposes and means of processing Personal Data.
“(Data) Processor” is an agency, entity, or legal person with responsibility for processing Personal Data on behalf of a Controller.
Emvia primarily provides its customers, which include both organizations and individuals, with communication services such as audio, video, email, chat, and delivering content over the internet. Emvia has limited knowledge of customer data within that platform, and only processes hosted data in accordance with the customer’s instructions. Emvia is a processor of hosted data, including customer content. The customer is the controller for that hosted data, including all their provided content. Such content on the customer’s account may be viewable to various sized audiences depending upon the customer-selected configuration of our Services.
Customers are responsible for maintaining the privacy of personal data pertaining to their Users and end-customers, in the customer’s capacity as the controller of personal data uploaded to our services. Emvia processes information under the direction of its customers and may have no direct relationship with the individuals whose personal data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to the Emvia customer.
Similarly, Emvia has limited control over the data collected by its Customers. Emvia Customers choose the geographical regions for the storage of data for which they are the Controller, are directly responsible for the configuration and administration of their Emvia Services and are responsible for adhering to legal and regulatory requirements, including the collection and maintenance of any necessary rights, permissions, and consents for the data which they collect and process as a data controller.
In some circumstances, such as during the new customer account registration process and the Implementation Phase, during billing procedures, and through your use of the services, Emvia collects and maintains personal data. This data is collected and maintained solely for the offer and maintenance of the services for customer use, and for the relevant communications and uses detailed within this policy. For these purposes, Emvia is the data controller.
The collection and processing of your personal data for direct use and administration of our services is based on contractual obligation, necessary to provide you with access and use of the services. Emvia also processes personal data where it has a legitimate interest to do so, where we have your consent, and where we are legally required. We have outlined the details for the types of personal data processing Emvia engages in above.
If you use an email address provided by an organization you are affiliated with (e.g., your employer) to access Emvia services, the owner of the domain (e.g., your organization) associated with your email address may control and administer your Emvia account, and may access and process your data, including the contents of your communications and files.
Your use of Emvia services may be subject to your organization’s policies and procedures. Emvia is not responsible for the privacy or security practices of our customers, which may differ from those set forth in this privacy statement. Personal data and privacy inquiries should be directed to your organization’s administrator.
Emvia acts as the data controller for personal data collected for company marketing purposes.
2.0 Personal Information We Collect
2.1 When data is collected
We may ask you to provide personal information when:
- You use the website to download articles, data sheets, or eBooks.
- You request a free trial or demo.
- You refer a deal to us.
- You connect with us directly via phone calls or video conferencing platforms.
- We or Client Account Administrators grant you access to the application.
- You or Client Account Administrators upload or enter personal information into the application.
- You participate in a marketing/sales promotion.
- You attend trade events and other industry networking events.
- You register or attend a webinar or other event.
- You participate in programs we may offer from time to time.
- You participate in chats.
- You pay for our services.
- You request to join our Partner Program.
If you choose to provide us with a third party’s personal information (the person’s name, email, and company), you represent that you have the third party’s permission to do so.
2.2 What data may be collected
We collect personal information that may include first and last name, business email address, phone number, company name as well as other personal information that is required to accomplish the requested task.
As an end user of the application, we collect your name, business email address, and any comments you make in the application.
In addition, we may collect data uploaded by you, your employer, or other users of the application that may be required to use Emvia services. We expect all users to follow their organization’s privacy policy and any applicable regulatory requirements when uploading, accessing, and using personal information into our application. The data uploaded may include personal information like:
- Employee names, email addresses, phone numbers, and contractual agreements
- Vendor names, email addresses, contractual agreements, or other personal data necessary for Emvia services
- Customer names and email addresses used to provide services within Emvia’s platform
- Personal information that is required to perform the request tasks
- As a job applicant, we may also collect your resume and cover letter.
2.3 Information we collect automatically
2.3.1 Tracking & Cookies Data
Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service.
We collect information about your visits to the website and the application when you land on any of our web pages through cookies and similar tracking technology.
We use cookies and similar tracking technologies to analyze trends, administer the services, track the activity on our Service and interactions with the platform and website, and hold certain information.
You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our service.
Examples of cookies we use:
- Session Cookies.We use session cookies to operate our Service.
- Preference Cookies.We use preference cookies to remember your preferences and various settings.
- Security Cookies.We use security cookies for security purposes.
We may also collect information on how the service is accessed and used ("Usage Data"). This usage data may include information such as device information including but not limited to connectivity, technical and aggregated usage data, such as user agent, your computer's Internet Protocol address (e.g. IP address), device data (e.g. type, OS, device id, browser type, browser version, locale, and language settings used), activity logs, session recordings, and the cookies and pixels installed or utilized on their device, the pages of our site that you visit, URLs that referred you to our website, the time and date of your visit, the time spent on those pages, unique device identifiers, and other diagnostic data.
We may also collect information when you open email messages from us or click on links within those email messages.
2.3.2 Customer Data
We collect and generate the following types of data relating to our customers and the Service:
- Customer account information (e.g., contact and billing details including Personal Data of account administrators, billing contacts and authorized signatories on behalf of the customer; as well as the customer’s needs and preferences, as identified to us or recognized through our engagement with them); and
- Information concerning our customers and prospects (e.g., contact and business details, our communications with such customers and prospects (correspondences, call and video recordings, and transcriptions and analyses thereof), as well as any needs, preferences, attributes, and insights relevant to our potential engagement).
- Customer’s end user information required to perform the requests tasks
We collect such data either automatically, through the data subject’s interaction with us or with our sites or services; or through third-party services, social media, analytics tools, events we organize or participate in, and other business initiatives. Similarly, if you contact our customer support team, we may automatically collect or request this information to aid in troubleshooting and error reporting.
We may also use analytics software to allow us to better understand the functionality of our Services. This software may record information such as how often you use the Services, the events that occur within the Emvia Platform, aggregated usage, performance data, etc.
2.3.3 Mobile App Data
When you download and use our services, we may automatically collect information on the type of device you use, operating system version and the device identifier (or “UDID”).
We may send you push notifications from time-to-time in order to update the services, or to notify you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you may turn them off at the device level.
We use mobile analytics software to allow us to better understand the functionality of our mobile software on your mobile device. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded from.
2.3.4 Links To Other Sites
Our service may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.
We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
2.4 Information we may collect from third parties
We may combine the information we collect from your direct interactions with us with information obtained through other third-party sources, such as LinkedIn, Salesforce, Zoominfo, channel partners, etc.
The personal information collected includes your name, email address, business address, job title, company name, and telephone number.
3.0 How We Use Personal Information
We may use your personal information to:
- Deliver the contracted services and allow full use of the application functionality as purchased by the Customers.
- Deliver training and support to our application end users and/or carry out the transactions you have requested.
- Communicate with you directly through emails, texts, calls, chats, video conferencing.
- Process payments for application subscriptions.
- Send communications to you about:
- New application features and upgrades.
- Our services and offerings.
- News and event announcements.
- Product notices and changes to our terms and policies.
- Particular programs in which you have chosen to participate.
- Promotional offers and surveys.
- Scheduling demos and managing free trials.
- Advertise and market our products and services, including delivering interest-based advertisements on this website and other sites or content syndication platforms and websites.
- Carry out market research to understand how to improve our services and their delivery.
- Create and manage marketing campaigns.
- Generate sales leads and increase our market share.
- Analyze user clicks and usage of the application and website to improve user experience and maximize usage of our services.
- Manage our website and application to maintain and deliver the contracted functionality and services.
- Enforce our website and application terms and/or separate contracts (if applicable) with you.
- Prevent fraud and other prohibited or illegal activities.
- Protect the security or integrity of the website, application, our business or services.
- Or otherwise, as disclosed to you at the point of collection or as required or permitted by law.
Please note that sometimes we may record the video conferencing or phone call in which you participate to analyze and improve our staff’s communication skills. If we do so, we will be announcing it at the beginning of the conversation.
We do not sell your information to any third party.
4.0 How We Share Personal Information
4.1 Our Application and Services
If you are an end user of our application, your personal information may be viewed by other users with access to the application.
4.2 Service Providers
We use third parties to help us provide our services. They will have access to your information as collected by the website or the application, as reasonably necessary to perform the contracted tasks on our behalf. We sign contractual agreements to obligate them to protect the personal information, only use it to deliver the contracted services to us, prohibit them from selling it and not disclose it without our knowledge and permission.
4.3 Analytics
Emvia utilizes analytics tools such as Google Analytics, FB Analytics, LinkedIn, Terminus, and Twitter. This data is primarily used to modify our marketing assets and campaigns.
4.4 Legal Disclosures
It is possible that we may need to disclose personal information when required by law, subpoena or other legal processes as identified in the applicable legislation. We attempt to notify our Customers about legal demands for their personal data when appropriate in our judgment unless prohibited by law or court order or when the request is an emergency.
4.5 Change in Control
We can also share your personal data as part of a sale, merger, change in control, or in preparation for any of these events.Any other entity which buys us or part of our business will have the right to continue to use your data, but only in the manner set out in this Privacy Policy unless you agree otherwise.
5.0 How We Secure Personal Information
We are committed to protecting the security of all of the personal information we collect and use. The security of your data is important to us but remember that no method of transmission over the internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.
Emvia Platform - We deploy reasonable technical and organizational measures to protect your data, for example, from manipulation, loss, and unauthorized third-party access. These measures include the use of encoding technologies, certificates, firewalls, and password protection. In addition, Emvia uses industry-standard encryption to facilitate the exchange and transmission of data. Our data security level is certified compliant to the Payment Card Industry Data Security Standard (PCI DSS). We are constantly reviewing and improving our security measures in accordance with technological advancement.
6.0 Your Rights
We provide the same suite of services to all of our Customers and end users worldwide. We offer the following rights to all individuals regardless of their location or applicable privacy regulations.
For personal information we have about you, you can:
6.1 Access your personal information or request a copy
You have the right to obtain information about what personal information we process about you or to obtain a copy of your personal information.
If you have provided personal information to us, you may contact us to obtain an outline of what information we have about you or a copy of the information.
6.2 Be notified of what personal information we collect about you and how we use it, disclose it, and protect it
This Privacy Policy describes what personal information we collect and our privacy practices. We may also have additional privacy notices and statements available to you at the point of providing information to us directly.
6.3 Change or correct your personal information
You have the right to update/correct your personal information or ask us to do it on your behalf.
You can edit your information through the user account in the application or ask us to change or correct it.
6.4 Delete or erase your personal information
You have the right to request the deletion of your personal information at any time. We will communicate back to you within reasonable timelines the result of your request. There may be circumstances where we may not be able to delete or erase your personal information, but we will inform you of these reasons and any further actions available to you.
6.5 Object to the processing of your personal information
You have the right to object to our processing of your personal information for direct marketing purposes. This means that we will stop using your personal information for these purposes.
6.6 Ask us to restrict the processing of your personal information
You may have the right to ask us to limit the way that we use your personal information.
6.7 Export your personal data
You have the right to request that we export to you in a machine-readable format all the personal information we have about you. We do not process personal information through the use of automated means.
6.8 Lodge a complaint
You also have the right to lodge a complaint with the local organizations in charge of enforcing the privacy legislation applicable in your territory.
7.0 How to Exercise Your Consumer Rights
To exercise your right to know and/or your right to deletion, please submit a request by contacting us at compliance@emvia.cx. Emvia will confirm receipt of your request within 10 business days.
Emvia will need to verify your identity before processing your request. In order to verify your identity, we will generally require sufficient information from you so that we can match it to the information we maintain about you in our systems. Sometimes we may need additional personal information from you to be able to identify you. We will notify you.
Emvia will respond to the request within 45 calendar days. We may decline a request to exercise the right to know and/or right to deletion, particularly where we cannot verify your identity or locate your information in our systems or as permitted by law. In the case where we are unable to comply with a request, we will provide the reasons for the denial.
You may choose to designate an authorized agent to make a request on your behalf. No information will be disclosed until the authorized agent’s authority has been reviewed and verified. Once an authorized agent has submitted a request, we may require additional information (i.e., written authorization from you) to confirm the authorized agent’s authority.
After giving us your consent for the collection, processing, and use of your personal data, you may withdraw such consent at any time with effect for the future. However, such revocation of consent will result in reduced functionality of the Service and/or prevent you from using the Service altogether.
Please bear in mind that, for technical or organizational reasons, there may be an overlap between you withdrawing your consent and your data being used, e.g., in the case of a newsletter which has already been sent out. Data required for billing and accountancy purposes, or which are subject to the legal duty to preserve records, are not affected by this.
Emvia will use reasonable security measures when transmitting personal information to the consumer.
If you are an employee/former employee of an Emvia client that uses our application and services, please direct your requests and/or questions directly to your employer/former employer.
If you are a third party (auditor, business associate, etc.), who was given access to the Emvia application by a Emvia client, please direct your requests and/or questions directly to the Emvia client that gave you access.
If Emvia complies with the consumer request, we will keep the request records for 24 months.
8.0 How Long We Keep Your Personal Information
We retain information as long as it is necessary to provide the services to you and our Customers, subject to any legal obligations to further retain such information.
We may also retain information to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce our Terms of Service and take other actions permitted by law.
The information we retain will be handled following this Privacy Policy.
Information connected to you that is no longer necessary and relevant to provide our services may be de-identified or aggregated with other non-personal data. This information may provide insights that are commercially valuable to Emvia, such as statistics of the use of the services.
9.0 Other Important Information
We will only collect and process your personal data where we have a lawful reason for its collection.
When you visit our website and provide us with your personal information, we collect and use it with your consent.
As an application end user, you consent to our collection of your personal information when you log in for the first time. However, your employer has control of the account and may upload and share additional personal information. Your employer’s responsibility is to ensure that collecting, using, and sharing the personal information uploaded to the application complies with all applicable legislation.

Where we rely on your consent to process personal data, you have the right to withdraw or decline your consent at any time. If you have any questions about the lawful bases upon which we collect and use your personal data, please contact us at compliance@emvia.cx.
9.1 How to select your communications preferences
You may choose to receive or not receive marketing communications from us. Please click the “Unsubscribe” link in the email we sent you to stop receiving marketing communications.
You may choose which information we collect automatically from your device by controlling cookie settings on your browser.
Even if you opt-out of receiving marketing communications, we may still communicate with you regarding security and privacy issues, servicing your account, fulfilling your requests, or administering any promotion or any program in which you may have elected to participate.
9.2 Minors Under Age 18
Our application and services are intended for business use, and we do not expect them to be of any interest to minors. We do not intentionally collect any personal information of consumers below the age of 18. We do not sell the personal information of California consumers.
10.0 Contact Information
You may contact us to exercise any of your rights or ask for more information about your personal information and our privacy practices by contacting us at compliance@emvia.cx.
Should you have any questions on the topic of data protection or should you wish to exercise your rights to withdraw consent or for information, rectification, deletion, or suspension, please contact us. Include your name, address, and phone number or email in all communications and state clearly the nature of your request.
You may also direct a complaint concerning compliance with Emvia directly at compliance@emvia.cx. The complaint must be in writing. Within a reasonable time of receipt of the complaint, the Privacy Officer will investigate the complaint. The format of this investigation will vary depending on the circumstances.
After the investigation into the complaint, Emvia may take appropriate measures necessary to rectify the source of the complaint if it is necessarily required.
Within a reasonable time of conclusion of the investigation, the Privacy Officer will inform you either verbally or in writing, of the result of its investigation into your complaint and any appropriate measures Emvia will take to rectify the source of the complaint if necessary.
Emvia is a service provider and may not be the Controller of your personal data. If you wish to exercise any of your rights as detailed above, please first contact the appropriate Emvia customer. You can also contact Emvia directly, using the email address above. If Emvia is not the controller responsible for responding to your request, we will forward the request to the appropriate Emvia customer. Where Emvia is the applicable controller, we usually act on requests and provide information free of charge but may charge a reasonable fee to cover our administrative costs of providing the information for baseless or excessive/repeated requests, or further copies of the same information. Alternatively, we may be entitled to refuse to act on the request.
Please consider your request responsibly before submitting it. These requests do not apply to mandatory service communications that are part of certain Services, nor to Personal Data controlled by Emvia’s customers. Generally, Emvia will respond within 45 days from when we receive your request, unless the request will take substantially longer to fulfill.
Appendix
A.1 For Individuals Based in the European Union (EU), European Economic Area (EEA) and Switzerland
If you are based in one of these jurisdictions, Emvia is the controller of your personal data collected in the following instances:
- When you visit our website: https://emvia.cx
- When we process your personal data for sales and marketing purposes
- When you engage with one or more of our Customer Service Representatives
Emvia is a processor of all personal data processed on the application, on behalf of our Customers. We only process the personal data under their direction. Please contact your employer or the organization that granted you access to the application, or the company we are providing service on behalf of for details on their privacy practices.
We only process personal data if we have a lawful basis for doing so. The lawful bases applicable to our processing as controller are:
- Consent: We will ask for your express and informed consent every time we collect your personal data on this legal basis.
- Contractual basis: We process the personal data as necessary to fulfill our contractual terms with you or our Customers.
- Legitimate interest: We process the names, contact details, job titles, companies of our existing and prospective Customers for our marketing purposes, including market research and sales leads generation.
You have the following rights under the GDPR:
- Be informed about the collection and use of your personal data
- Access your personal data
- Correct errors in your personal data
- Erase your personal data
- Object to the processing of your personal data.
- This right is also available to individuals whose personal data is processed by us for direct marketing purposes. If you object to the processing of your personal data for direct marketing purposes, we shall stop processing within 30 days of receipt of your request.
- Export your personal data
- Restrict our processing of your personal data for specific reasons, including any of the purposes supported by the legitimate interest legal bases (see the section above).
Personal data obtained through Emvia Platform is stored in geo-redundant sites except where a Customer contract provides otherwise. Personal data collected through our website, conferences, etc. is shared with our service providers. We use standard contractual clauses as the data transfer mechanism of transferring EU data to countries subject to data transfer requirements.

A.2 For Individuals Based in California
This section provides additional specific information for consumers based in California as required by the California Consumer Privacy Act of 2018 (“CCPA”).
A.2.1 Collection and Use of Personal Information
In the last 12 months, we have collected the following categories of personal information:
- Identifiers, such as your name, mailing address, email address, zip code, telephone number or other similar identifiers that are required to perform the requested services
- California Customer Records (Cal. Civ. Code § 1798.80(e)), such as username and password, company name, job title, business email address and department, personal information that is required to perform requested tasks
- Internet/network information, such as your browsing history, log and analytics data, information about the device(s) used to access the services and information regarding your interaction with our websites or services and other usage data
- Geolocation data, such as information about your location (at country and city level) collected from your IP address
- Sensory Information, the content, audio and video recordings of conference calls between you and us that we record where permitted by you and/or the law
- Profession/employment information that you send to us when applying for a position included in your CV and cover letter
- Other personal information, such as personal information you provide to us in relation to a survey, comment, question, request, article download or inquiry and any other information you upload to our application
We collect personal information directly from you, from your browser or device when you visit our websites, from third parties that you permit to share your information or from third parties that share public information about you, as stated above.

Notice to California, Virginia, Colorado, Connecticut, and Utah Residents
If you are a California, Virginia, Colorado, Connecticut, and Utah resident who has provided Personal Data to Emvia, or a resident of such state that reasonably believes that Emvia collected or stores their Personal Data, you may exercise your rights under the state legislation and submit your request to the email address below.
NOTE: we do not sell your Personal Data or Personal Information as these terms are defined in the California Consumer Privacy Act (“CCPA”), the Virginia Consumer Data Protection Act, the Colorado Privacy Act, or under Nevada Law (Section Chapter 603A of the Nevada Revised Statutes).
You have the following rights:
Right to know about Personal Information collected, disclosed, or sold. Residents of these states have the right to request that we disclose what categories of Personal Data that we collect, use, disclose about you. You may also request the specific pieces of Personal Data that we have collected about you.
Right to request deletion of your Personal Data. You may also request that we delete any Personal Data that we have collected from you, provided that we may retain Personal Data as authorized, including, but not limited to, retaining Personal Data necessary to provide our Services, detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, debug to identify and repair errors that impair our Services, enable solely internal uses that are reasonably aligned with your expectations based on the your relationship with us, comply with a legal obligation or otherwise use your Personal Data, internally, in a lawful manner that is compatible with the context in which you provided it.
In order to submit a request, we will need to verify your identity. If you have an account with us that is password-protected, we may verify your identity through our existing authentication practices for your account. If you do not have an account with us, we may request from you two or more data points of personal information to verify your identity.
We will process and respond to your request within 45 days after it is received (in some cases, as is allowed under the CCPA, this process may be extended by an additional 45 to 90 days).
Notice of Information We Collect
Pursuant to California Civil Section 1798.100(b), this serves as notice of the categories of Personal Data that we collect through the site and Services and the commercial purposes for which the information was collected. Please note that all of the categories of Personal Data we collect about you (as detailed below) come from the following categories of sources:
- You, including through your use of our services
- Automatically collected from you
- Our affiliate companies
- Third parties
A.2.2 Recipients of Personal Information
We share personal information with third parties for business purposes. The categories of third parties to whom we disclose your personal information may include: (i) our service providers and advisors, (ii) marketing and strategic partners; (iii) B2B intent data and visitor identification providers for the purpose of identifying business visitors to our website and facilitating sales outreach; (iv) analytics providers; and (v) social networks.

As a California resident, you may be able to exercise the following rights in relation to the personal information about you that we have collected (subject to certain limitations at law):
